Welcome to SocialXia. By accessing our website, engaging our services, or signing a proposal, you agree to be bound by these Terms and Conditions.

1. General Terms

SocialXia ("Agency", "We", "Us") provides digital marketing and development services to the Client ("You"). These terms govern the relationship between the Agency and the Client.

We reserve the right to update these terms at any time. Continued use of our services implies acceptance of the updated terms.

2. Scope of Services

2.1 Web Development

We build websites using modern technologies (React, Next.js, WordPress). While we ensure the site functions correctly upon delivery, we are not responsible for issues caused by third-party plugin updates or hosting server errors after the handover, unless a maintenance package is active.

2.2 SEO & GMB Ranking

Important Disclaimer: No agency can guarantee a specific ranking (e.g., "#1 on Google") as search algorithms are proprietary to Google and change frequently.

We employ white-hat, best-practice strategies to improve your visibility. Rankings are influenced by hundreds of factors, many outside our direct control.

2.3 Performance Marketing (Ads)

Ad Spend: The budget paid to platforms (Meta, Google) is separate from our management fee. The Client is responsible for paying ad spend directly to the platform.

3. Payments & Billing

  • Project-Based Work: A 50% non-refundable deposit is required to commence work. The remaining 50% is due upon completion.
  • Retainers: Monthly fees (SEO/SMM) are billed in advance on the 1st of every month.
  • Late Payments: Invoices overdue by more than 7 days may result in a temporary suspension of services.

4. Intellectual Property

Upon full payment, the Client owns all final deliverables (website code, graphics, content). SocialXia retains the right to use the work in our portfolio unless an NDA is signed.

5. Limitation of Liability

SocialXia shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. We are not responsible for downtime caused by third-party hosting providers (e.g., AWS, GoDaddy).

6. Termination

Monthly Services: Either party may terminate a monthly retainer agreement with 30 days' written notice.

Fixed Projects: If the Client cancels a project after work has commenced, the initial deposit is forfeited.

7. Governing Law

These terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
